The Wage Claim Settlement: What Makes a Good Deal

Most DLSE wage claims settle at or before the settlement conference. Understanding what makes a good settlement — and what to watch out for — helps workers maximize their recovery.

Elements of a Good Settlement

A fair settlement covers: the full amount of underpaid wages (or a reasonable compromise if there is genuine dispute), meal and rest period premiums, applicable interest, a reasonable portion of PAGA penalties if applicable, and — if the employer has behaved egregiously — attorney fees if you have representation. A settlement that pays only the disputed wages without premiums and penalties significantly undervalues the claim.

Get the settlement in writing before you sign anything. Oral agreements in wage claim proceedings are unenforceable. A settlement agreement should specify: the amount paid, what claims it resolves, whether it releases future claims, and whether it affects your employment status. Never release a PAGA claim for individual settlement only — PAGA claims belong to the state and require LWDA approval to release.
