Domestic Worker Wage Rights: The Forgotten Workforce

California’s domestic workers — nannies, housecleaners, caregivers, personal attendants — are among the most vulnerable to wage theft and among the least likely to file claims. California’s Domestic Workers Bill of Rights extended significant protections to this workforce.

What the Law Provides

Personal attendants (nannies, caregivers) who work for private households are entitled to: overtime for hours worked beyond 9 per day or 45 per week, meal and rest period protections, minimum wage, and the same DLSE claim rights as any other worker. Workers employed through a third-party agency are covered by standard California overtime rules.

Most full-time domestic workers are entitled to overtime they’ve never received. A caregiver who works 10 hours per day, six days a week, has been working substantial overtime for every week of employment. The three-year lookback on a case like this can produce a significant claim. Domestic workers who are paid cash or off the books are still entitled to these protections — the payment method doesn’t affect the legal obligation.
