DLSE vs. BOFE

BOFE conducts industry-wide investigations — it can inspect employer records, audit multiple workers’ pay simultaneously, and issue citations that affect the whole workforce. BOFE is most useful for systemic violations affecting many workers. Individual DLSE claims are faster for individual recovery. PAGA bridges both — it’s filed by one worker but recovers penalties on behalf of all affected employees.

You can use multiple pathways simultaneously. Filing an individual DLSE claim doesn’t prevent you from also sending a PAGA notice and pursuing a civil action.
